Tidy Money LLC, EIN: 30-1415874, address 1209 Mountain Road PL NE, STE R Albuquerque, NM 87110, Bernalillo County (USA) (hereinafter “Tidy”), processes personal data of individuals who use the information society service tidymoney.io (tidymoney.io and its subdomains, including but not limited to blog.tidymoney.io, and the Tidy Money App, hereinafter referred to as “tidymoney.io”).

1. Acceptance of Terms

By downloading, installing, subscribing to, and using the Tidy Money App or Tidy Money PRO service, you agree to be bound by these Terms of Use. If you do not agree, you must not use the application or services.

2. Service Description

Tidy Money is a financial management app that allows users to record, categorize, and analyze income, expenses, and budgets for improved financial planning.

Tidy Money PRO is a paid subscription service that includes, among other features:

Scanning of receipts and invoices using the smartphone camera.
Automated expense categorization, extraction of tax amounts and taxable base.
Enhanced CSV exports enriched with detailed tax data.
Removal of visual advertising from the App’s home screen.
Cloud storage of scanned receipts and invoices, with user access and downloads.
Planned future features:
- Direct CSV exports to Sage Accounting, Sage 50, QuickBooks, and XERO.
- AI-powered financial assistant (text and voice) to provide financial insights, cost-saving suggestions, provider comparisons, travel and vehicle purchase recommendations, and financing options.

3. Account Registration

To use the services, you must create an account with accurate and up-to-date information. You are solely responsible for safeguarding your login credentials.

4. Subscription, Billing, and Cancellation

Tidy Money PRO is billed on a monthly subscription basis.
Payments are charged in advance and are non-refundable, regardless of usage.
Cancellation may be requested at any time, but cancellation only prevents future renewals. You will continue to enjoy the service until the end of the current billing cycle.
No partial refunds or prorated credits will be issued.

5. Acceptable Use

You must comply with all applicable laws and regulations when using Tidy Money. Prohibited uses include fraudulent activity, illegal conduct, hacking, or attempts to disrupt the platform.

6. Intellectual Property

All intellectual property rights in the App, including content, design, trademarks, and code, belong to Tidy Money LLC. No license or right is granted beyond what is expressly stated in these Terms.

7. Advertising and AI Recommendations

Free version: Tidy Money displays visual advertising on the App’s home screen, including direct links to third-party services or products.
PRO version: such visual advertising is removed. However, the AI assistant may include suggestions, comparisons, or recommendations that contain links to third-party services or products. These are considered part of the advisory functionality and not direct advertising.
Tidy does not guarantee the quality, legality, or suitability of any third-party service. Users acknowledge that engaging with third-party services is at their own risk.
Tidy may, now or in the future, receive compensation or commissions for referrals, which users expressly accept.

8. Limitation of Liability and Disclaimer of Warranties

The Services are provided “as-is” and “as-available” without warranties of any kind, whether express or implied.

You acknowledge and agree that:

Tidy does not guarantee uninterrupted access, error-free operation, or permanent data availability.
Cloud storage of receipts and invoices is provided as a convenience only; Tidy is not liable for any loss, corruption, or unavailability of data or files.
Recommendations, analyses, or suggestions made by the AI assistant are for informational purposes only. They do not constitute legal, tax, investment, or financial advice. Decisions made based on such information are the sole responsibility of the user.
Tidy, its affiliates, and its employees shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to financial loss, missed savings, opportunity costs, or reliance damages arising from use of the service.

Maximum liability of Tidy Money LLC under these Terms shall not exceed the total fees paid by the user during the three (3) months immediately preceding the claim.

9. Age Requirement

Age Restriction

The Services are intended solely for individuals who are at least 18 years of age (or the age of majority in their jurisdiction, whichever is higher). By using the App, you represent and warrant that you meet this requirement. Tidy Money does not knowingly collect personal data from individuals under 18. If we become aware that we have inadvertently collected such data, we will take reasonable steps to delete it.

10. Professional Disclaimer

AI recommendations do not replace certified tax, legal, or financial advice. Users remain responsible for their own financial and contractual decisions.

11. Data Protection and Privacy

Data (receipts, invoices, financial info) may be processed and transferred internationally, including to the U.S.
Tidy does not sell personal data. Advertising is based on anonymized usage patterns.
Users in the EU, California, or other jurisdictions with specific data protection laws may exercise their rights (access, correction, deletion, portability) by contacting team@tidymoney.io.
Tidy applies reasonable security measures but does not guarantee absolute protection against unauthorized access or data loss.

12. Restricted Jurisdictions

You may not use Tidy Money if you are located in embargoed or sanctioned countries (e.g., Cuba, Iran, North Korea, Syria) in compliance with U.S. law.

13. Suspension and Termination

Tidy may suspend or terminate accounts for violations of these Terms. Users may request account deletion at any time.

14. Future Features and Beta Services

Certain functionalities (e.g., CSV export to third-party accounting systems, AI assistant) may be released as beta or pre-production services. By using them, you acknowledge they may contain errors and agree to use them at your own risk.

15. Use License (Mobile App)

16. Modifications to the Terms

Tidy reserves the right to modify, amend, or update these Terms of Use at any time, at its sole discretion. The updated version will be published within the App or on tidymoney.io, with the “Last Updated” date revised accordingly.

By continuing to access or use the Services after any modifications, you agree to be bound by the revised Terms. If you do not agree, you must immediately stop using the Services and terminate your account.

Tidy is not obligated to provide individual notice of changes. It is the sole responsibility of the user to review the Terms periodically to remain informed of any updates.

17. Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue any service, feature, or subscription plan at our discretion and without liability. Service availability is not guaranteed at all times.

18. Arbitration and Governing Law

Any dispute shall first be addressed in writing to Tidy Money LLC.
In the U.S., disputes shall be resolved by binding arbitration in Albuquerque, New Mexico, under AAA rules.
These Terms are governed by the laws of the State of New Mexico, USA.
